1. Acceptance of Terms

By accessing and using the PaintorAI service, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our service.

2. Service Description

PaintorAI allows users to upload a photo of their interior room. In response, users will receive multiple AI-generated visualizations of their room painted in various colors, helping them make confident color decisions before committing to a paint purchase.

3. Use of the Service

The service is priced at $15 per room visualization. Upon successful payment, users will receive their set of color visualization images.

4. Ownership & Usage Rights

Upon receipt of the generated images:

• The user is granted full ownership rights over all images produced by PaintorAI for their order.
• Users have the unrestricted right to use, modify, distribute, and reproduce the images in any manner and for any purpose they see fit without any additional payment or attribution to PaintorAI.

5. User Responsibilities

Users must:

• Ensure they have the rights to the photos they upload.
• Not upload content that is illegal, defamatory, offensive, or contains identifying information of other individuals without their consent.
• Comply with all applicable laws while using the service.
• Not use the service for any commercial resale or service bureau purposes without prior written consent.

6. Intellectual Property

While users own the images produced by PaintorAI for their specific orders, all underlying software, algorithms, designs, AI models, and intellectual property related to PaintorAI remain the exclusive property of PaintorAI. Unauthorized use, duplication, or reverse engineering of our software or methodologies without express written permission is prohibited.

7. Service Accuracy & Limitations

PaintorAI uses artificial intelligence to generate visualizations. While we strive for accuracy, the generated images are artistic representations and may not perfectly match real-world paint colors due to variations in lighting, camera quality, screen calibration, and other factors. Final paint color decisions should be made with physical paint samples.

8. Limitation of Liability

To the fullest extent permitted by applicable law, PaintorAI will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of PaintorAI, including but not limited to dissatisfaction with paint colors chosen based on our visualizations.

9. Refund Policy

All sales are final. Due to the digital nature of our service and the computational resources required, refunds are not provided once the images have been generated and delivered. If you experience technical issues preventing delivery, please contact our support team.

10. Privacy & Data Usage

Uploaded photos are used solely for generating your visualizations. We do not share, sell, or use your images for any other purpose without your explicit consent. Images may be retained temporarily for service delivery and quality improvement purposes.

11. Termination

We reserve the right to suspend or terminate your access to our service at any time, without notice, for conduct that we believe violates these Terms of Service, is harmful to other users, us, third parties, or for any other reason at our sole discretion.

12. Changes to Terms of Service

We may periodically revise these Terms of Service. Each revised version will be dated and posted on our platform. Continued use of the service after changes constitutes acceptance of the new terms. We recommend reviewing our Terms of Service frequently to stay informed.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States of America. Any disputes arising under or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the federal and state courts located within the United States.
